Terms & Conditions

Please read these Terms & Conditions before booking. By making a booking, checking in or staying at Paradise Pods, you agree to them and to the House Rules.

1. Overview

These Terms & Conditions apply to bookings and stays at Paradise Pods. They form part of the agreement between Paradise Pods and the person making the booking, together with the booking confirmation, rates, House Rules and any written special conditions. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

2. Booking requirements

To make or maintain a booking, guests must provide accurate and complete:

  • full name and current contact details;
  • dates of stay and expected arrival time;
  • number of guests and any requested age information;
  • valid identification when reasonably requested; and
  • information reasonably required for safety, security, payment or legal compliance.

Guests must be at least 18 years old. Each sleeping pod is for single occupancy only. A booking may not be transferred or resold without Paradise Pods’ written approval.

3. Check-in and check-out

Late check-out is subject to availability and must be approved in advance. If a guest remains after the approved time, Paradise Pods may charge the reasonable additional accommodation, staffing or loss costs caused, in addition to the stated late check-out fee.

4. Prices and payment

All prices are in Australian dollars and include GST where applicable. Accommodation charges must be paid by check-out or at any earlier time stated in the booking confirmation or reasonably requested by Paradise Pods. A booking may require pre-authorisation, a deposit or payment in advance. We accept major credit and debit cards and approved digital payment methods. Any clearly disclosed card surcharge will not exceed the reasonable cost of acceptance.

Guests authorise Paradise Pods to charge an agreed payment method for amounts properly payable under these terms, including authorised accommodation charges and reasonable costs for damage or additional cleaning, subject to applicable law.

5. Cancellations, changes and no-shows

Unless a different cancellation policy is clearly stated in the booking confirmation, the following fees apply. Percentages are calculated on the total price of the cancelled accommodation.

A request to shorten or change a booking may be treated as a cancellation of the affected nights. Where required by law, any cancellation fee will be limited to an amount Paradise Pods is entitled to retain, having regard to its reasonable losses, costs and ability to rebook the accommodation.

6. Changes or cancellation by Paradise Pods

Paradise Pods may decline, cancel or terminate a booking where reasonably necessary, including if a guest:

  • engages in unsafe, unlawful, threatening, abusive, violent or seriously disruptive behaviour;
  • poses a material health, safety, security or fire risk;
  • intentionally or negligently damages property;
  • seriously or repeatedly breaches these terms, the House Rules or reasonable staff directions;
  • is intoxicated or affected by drugs to a level that creates a safety or disruption risk;
  • brings a weapon, illegal substance or other prohibited item onto the premises; or
  • provides materially false booking, identity or payment information.

Where practical, Paradise Pods may first give a warning and a reasonable opportunity to stop the conduct. Immediate termination may occur where the risk or conduct is serious. A guest whose stay is terminated for their breach may remain responsible for amounts permitted by law, including reasonable loss or damage.

If Paradise Pods cancels for reasons not caused by the guest, it will refund fees paid for accommodation that cannot be provided and will provide any additional remedy required by the Australian Consumer Law.

7. Guest responsibilities and House Rules

Guests must:

  • follow these terms, all posted House Rules, fire-safety requirements and reasonable staff directions;
  • respect other guests, neighbours and staff;
  • keep noise at a reasonable level, particularly during designated quiet hours;
  • keep their pod and shared facilities reasonably clean;
  • use the premises, pods, lockers and facilities safely and only for their intended purpose;
  • not allow an unregistered person to occupy or share a pod; and
  • take reasonable care of keys, access credentials and personal belongings.

Guests are responsible for the reasonable cost of repairing damage they intentionally or negligently cause, excessive cleaning beyond ordinary use, replacement of lost access items, and emergency-service or fire-alarm call-out charges directly caused by the guest’s prohibited or negligent conduct. Paradise Pods will provide reasonable details of any charge.

8. Smoking, vaping and fire safety

Paradise Pods is strictly smoke-free and vape-free inside the building, including pods, bathrooms and common areas. Guests must not interfere with smoke alarms, sprinklers, fire doors or other safety equipment. A breach may result in termination of the stay and the guest being required to leave. The guest may also be charged the reasonable cost of additional cleaning, damage, lost accommodation revenue and fire-alarm or emergency call-outs caused by the breach, to the extent permitted by law.

9. Personal property, valuables and lockers

Guests are responsible for taking reasonable care of their belongings and should secure valuables in any designated locker. Paradise Pods is not responsible for loss, theft or damage except to the extent liability cannot lawfully be excluded or limited, including under the Australian Consumer Law and applicable Queensland traveller-accommodation legislation.

10. Items left behind

  • Perishable, hazardous, illegal or unhygienic items may be disposed of immediately.
  • Other items will ordinarily be held for 7 days after discovery.
  • Guests are responsible for reasonable packaging, postage or courier costs for returned items.
  • After the holding period, unclaimed items may be donated, recycled, disposed of or dealt with as required by law.

Paradise Pods does not guarantee that an item will be found or recovered and may require satisfactory proof of ownership before releasing it.

11. Internet use

Internet access is provided as a convenience and may be interrupted, limited or unavailable. Guests are responsible for their devices and online activity. They must not use the service for unlawful conduct, harassment, fraud, copyright infringement, malicious software, unauthorised access or activity that materially interferes with the network or other users.

12. Parking and transport

Paradise Pods does not provide on-site parking. Guests are responsible for checking signs, restrictions, fees and security arrangements for any public or third-party parking they use. Paradise Pods is not liable for vehicle theft, damage, loss, towing or fines except to the extent liability cannot lawfully be excluded.

13. Privacy

Paradise Pods handles personal information in accordance with its Privacy Policy, available through its website or reception. Guests should review that policy for information about bookings, identification, payments, CCTV, access and correction requests, complaints and data security.

14. Complaints and disputes

Guests should raise concerns promptly with reception so Paradise Pods has a reasonable opportunity to respond. If a dispute cannot be resolved directly, either party may pursue any complaint, tribunal or court process available under applicable law. Nothing in this clause limits a guest’s statutory rights.

15. Changes to these terms

Paradise Pods may update these Terms & Conditions from time to time. The version accepted at the time of booking will ordinarily apply to that booking, unless a change is required by law, agreed with the guest, or is reasonably necessary for safety and does not materially disadvantage the guest. The current version will be available on the Paradise Pods website or from reception.

16. General and governing law

These Terms & Conditions are governed by the laws of Queensland, Australia. The parties submit to the courts and tribunals with jurisdiction in Queensland, subject to any law that gives a consumer the right to bring proceedings elsewhere. If any provision is invalid or unenforceable, it is to be read down to the extent possible and otherwise severed without affecting the remaining provisions. A delay in enforcing a right is not a waiver of that right.

Operational review: confirm the legal entity name, address, contact details, House Rules, accepted payment methods, quiet hours, prohibited-items list and any specific cleaning, key or security-deposit charges before publication.
